note that a lot of these tests need to be flipped to "should fail like X" instead of "should work" as master branch had different semantics on these than 3.5.x. Will work on fixing these up

i think i now need a follow-up on the original to get rid of the comments about "these tests are supposed to fail on 3.5.x"
