Error building 7581 after 'git clone'

First I had done a new installation of Debian 12, and after installing all the required bits, I followed that with git clone. I then started make menuconfig, and selected 7581, and AVM international. At last I started the new build with make.
It proceeded to build for quite some while, but then, when it probably reached the kernel stage, it threw the following error.

Its because of the patch added for #1101

Unfortunately, that didn't fix the issue, after a new clone I still get an error message.
However, as it looks like the patch has been disabled, I've tried building the firmware after removing folder 4.1.38. This allows the build to complete successfully. After placing back the folder, including the patch file with original file name, I could then finally build successfully with the fix. I'm assuming this fix will work when you have built the firmware successfully earlier at least once.
