[BUG] hides when I open finder or background (hide in fullscreen is enabled)

Describe the bug
I love the function of it hiding when I have an app in fullscreen. but it thinks that finder is constantly in fullscreen. so when I got to my background or if I open finder (not in fullscreen) it hides the notch

Expected behavior
that if I open finder or go to my background the media player in the notch doesn't hide. but when I open a different app in fullscreen it does hide
